(1) Notwithstanding anything written in the existing law, if any fugitive accused or criminal cannot be extradited according to sub-section (5) of section 14 or sub-section (2) of section 16 If it is requested that such an offense is also considered as an offense under Nepal law, then the Ministry shall take action against such accused in accordance with the law.

(2) Regardless of what is written in the existing law, action should be taken against the fugitive accused according to sub-section (1). If necessary, the relevant District Public Prosecutor shall file a case before the court or other competent body.

(3) When proceeding against the fugitive offender as per sub-section (1), such offender has been found guilty by the court or other competent body of the requesting state. If so, the punishment will be executed in accordance with the prevailing law.

(4) According to this section, the court or other competent body regarding the fugitive accused or the criminal shall inform the requesting state of the decision and the punishment.
